1. Acceptance of Terms

By accessing, browsing, or purchasing from bergencountysupply.myshopify.com (the "Website" or "Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, do not use this Service.

These Terms apply to both individual consumers (B2C) and business customers (B2B), including salons, barbershops, and other professional establishments.

2. Use License

We grant you a limited, non-exclusive, revocable license to:

  • Access and view our Website for lawful purposes
  • Make legitimate purchases of products for personal use or lawful business use

You agree not to:

  • Resell or redistribute products without authorization
  • Copy, modify, or create derivative works from our Website content
  • Attempt to reverse-engineer, hack, or interfere with Website security
  • Use automated tools (bots, scrapers) to access our Service without permission
  • Engage in unlawful activity or violate any laws

3. Product Descriptions & Availability

  • Accuracy: We strive to provide accurate product descriptions, images, and specifications. However, we do not warrant that descriptions are error-free or complete.
  • Availability: Products are listed as available subject to inventory. We reserve the right to refuse or cancel orders due to out-of-stock items or other operational reasons.
  • Pricing: Prices are subject to change without notice. Prices are displayed in USD and do not include applicable sales tax (calculated at checkout).
  • No Warranty of Description: All products are sold "as is" unless explicitly stated otherwise. Product titles, descriptions, and marketing language are provided in good faith but do not constitute warranties.

4. Product Warranties & Disclaimers

Limited Warranty

Products are provided with standard manufacturer warranties (if applicable). Warranty coverage, terms, and claim procedures are determined by the original manufacturer and included in product documentation.

Bergen County Supply makes no additional warranties beyond those provided by the manufacturer. We do not warrant that products are:

  • Fit for a particular purpose beyond their ordinary use
  • Defect-free (except as covered by manufacturer warranty)
  • Suitable for professional use without testing and care

Disclaimer of Implied Warranties

To the fullest extent allowed by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Professional Use Disclaimer

Products sold for professional barbering, salon, or cosmetic use must be used in compliance with applicable federal, state, and local regulations, including FDA, OSHA, and professional licensing requirements. You are responsible for ensuring proper use, training, sanitation, and regulatory compliance. Bergen County Supply is not liable for misuse, improper application, or regulatory non-compliance.

5. Pricing & Payment

  • Pricing: All prices are in USD. Applicable state and local sales tax will be added at checkout.
  • Payment: We accept major credit cards and Shopify payment methods. Payment information is processed securely through PCI-DSS-compliant third-party processors.
  • Authorization: By submitting payment, you authorize us to charge your payment method for the order total plus tax and shipping.
  • Failed Transactions: If a payment is declined, we will attempt to contact you. Repeated failed payments may result in order cancellation.
  • Billing Errors: Notify us immediately of any billing errors. We will investigate and correct them within 30 days.

6. Shipping & Delivery (US Only)

  • Shipping Availability: We ship to addresses within the continental United States only. We do not ship to PO boxes, APO/FPO addresses, or international locations unless otherwise specified.
  • Shipping Timeline: Orders typically ship within 2–5 business days. Delivery times depend on carrier and destination (typically 3–10 business days domestically).
  • Risk of Loss: Products are at your risk once shipped. We recommend signature confirmation for high-value orders.
  • Tracking: You will receive tracking information via email. Monitor your shipment and contact the carrier directly with tracking questions.
  • Delays: Shipping delays due to carrier issues, weather, or other unforeseen circumstances are not our responsibility, but we will assist in investigating and claiming damages if necessary.
  • Damage in Transit: If a package arrives damaged, document the damage with photos, contact the carrier and us immediately. Do not refuse delivery; accept the package and file a carrier claim.

7. Returns & Refunds (30-Day Window)

Return Eligibility

  • 30-Day Window: Products may be returned within 30 days of purchase for a refund or exchange
  • Condition: Products must be unused, unopened, and in original packaging with all parts included
  • Exceptions – Non-Returnable Items:
    • Clearance or final-sale items (marked at purchase)
    • Custom-ordered or special-order products
    • Opened or used beauty/hygiene products (for health/safety reasons)
    • Products damaged by customer mishandling
    • Items purchased more than 30 days ago

Return Process

  1. Contact us at bergencountysupply@gmail.com with your order number and reason for return
  2. Receive instructions for returning the product (customer pays return shipping unless defective)
  3. Ship the item to the address provided in its original, undamaged packaging
  4. Inspection: Upon receipt, we inspect the item. If it meets return criteria, we process a refund to the original payment method within 5–7 business days

Refund Details

  • Amount: Full refund of product price minus return shipping (unless defective)
  • Exceptions:
    • Original shipping is non-refundable
    • Discounted or clearance items may have restocking fees
  • Payment Method: Refunds are issued to the original payment method only

Defective Products

If a product is defective (fails to function as described within 30 days), contact us immediately with photos/evidence. We will arrange a replacement or refund at no cost, including return shipping.

8. Order Cancellation

  • Before Shipment: You may cancel an order before it ships. Email bergencountysupply@gmail.com immediately.
  • After Shipment: Once an order has shipped, you cannot cancel it. Your only recourse is the 30-day return policy above.
  • Cancellation Refund: Approved cancellations are refunded to the original payment method within 5–7 business days.

9. Limitation of Liability

To the fullest extent allowed by law:

  • Indirect Damages: We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our Service or products (including lost profits, lost revenue, lost business opportunity, lost data)
  • Direct Damages Cap: Our total liability for any claim shall not exceed the amount you paid for the product(s) in question
  • Service Availability: We make no guarantee regarding uninterrupted availability of our Website. We are not liable for downtime, data loss, or service interruptions

10. Indemnification

You agree to indemnify, defend, and hold harmless Bergen County Supply, its officers, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your misuse of products
  • Your violation of applicable laws or professional regulations
  • Your negligence or misconduct

11. Product Safety & Regulatory Compliance

  • Your Responsibility: You are responsible for ensuring that all products are used in compliance with applicable federal, state, and local laws, including FDA, OSHA, EPA, and professional licensing requirements.
  • Professional Use: If using products in a professional setting, ensure all staff are trained, licensed, and follow proper sanitation and safety protocols.
  • Safety Data Sheets (SDS): Product safety information is available upon request or from manufacturer documentation. Review SDS before using professional-grade products.
  • We Are Not Liable for:
    • Regulatory fines or penalties resulting from misuse
    • Professional licensing violations
    • Health or safety incidents arising from improper use or failure to follow manufacturer instructions

12. Intellectual Property

  • Website Content: All text, images, designs, logos, and other content on our Website are our property or licensed to us. You may not reproduce, distribute, or modify them without permission.
  • User Content: Any reviews, photos, or feedback you post become our property and may be used for marketing without further compensation.

13. Dispute Resolution & Governing Law

  • Governing Law: These Terms are governed by the laws of New Jersey, without regard to conflict of laws principles
  • Jurisdiction: You agree to submit to the exclusive jurisdiction of courts in Bergen County, New Jersey
  • Informal Resolution: Before litigation, both parties agree to attempt good-faith resolution of disputes via email communication
  • No Class Actions: You agree not to pursue class action or representative proceedings

14. Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it valid, or severed. The remaining Terms remain in full effect.

15. Changes to Terms

We may update these Terms at any time. The "Last Updated" date indicates the current version. Continued use of our Service after changes constitutes your acceptance of new Terms.
